From the below I understand the answer to be, definitely over 3 years, but additionally I am calculating you need to be (135cm) 4ft 5inches tall, but the individual booster seat will state this

EU Law:

https://eur-lex.europa.eu/legal-content/EN/TXT/HTML/?uri=CELEX:32003L0020&qid=1435040933692&from=EN

http://ec.europa.eu/transport/road_safety/going_abroad/united_kingdom/seat_belts_en.htm

https://babyseat.fundacionmapfre.org/children/regulations/european-union-legislation/

"Children aged 12 or 13 or over 135 cm in height must use an adult seat belt." - i.e. any normal seat is fine at this point

"Children under the age of 3 must use an appropriate child restraint system, whether travelling on the front or the rear seat." - Under 3 MUST use child seat

"- without prejudice to point (ii), children aged three and over and less than 150 cm in height shall occupy a seat other than a front seat;"... "(ii) Member States may allow, in their territory, children of less than 150 cm in height and of at least 135 cm in height to be restrained by a safety belt for adults." - i.e. must be minimum of 135cm tall or 150cm depending on particular country

EDIT: Always so complicated, UK law changed in Feb 2017 and it depends on when the car seat was manufactured.....  ??? an old seat is still legal as long as you are following the rules stated for that particular seat

If it's a booster manufactured after Feb 2017, then it cannot be a backless booster seat for children shorter than 125cm or weighing less than 22kg
