Although this project was "declared null and void by the Spanish courts," by a ruling of the Canary Islands High Court of Justice (TSJC) of 2006, which annulled the partial plan, the EC explained that "the works continued under a modified project" , so it has decided to open the formal infringement procedure. Spain has two months to respond to the Commission, and if it does not do so, it could send a reasoned opinion or a second warning letter.

The partial plan 'Casas de Majanicho' has been involved in controversy since in December 2000 the City Council of La Oliva, being Mayor González Arroyo, approved in plenary session, with the eight votes in favor of the Popular Party (PP) and five against of the councilors of CC and PSOE, the aforementioned urban plan, despite the fact that it did not have the pertinent technical reports and that public participation in the processing of the ordination instruments had been violated. A major new conurbation, intended for residential use, on an otherwise worthless plot of land set in the Spanish equivalent of an 'area of outstanding beauty/scientific interest'; no beach, miles from any other residential areas and even further from commercial centres; no public consultation, no impact studies......what on earth could have persuaded the mayor and his party to give it the go-ahead in the first place?!😳
