Good evening all.

We have a house Tamaragua. calle HULAN and our neighbour who i do no know and hve never seen has added a layer of blocks to the deviding wall and in doing so had damaged our paintwork and rendering..
A friend sent a photo and it looks dreadful.
I am sure the builders have been in our garden to carry out the works.
How can i make sure they make god the wall and are they allowed to just build higher without consultation.
We are in the uk and are at a loss as to what the legalities are.
My wife is coming back in may for holiday.

Does anyone know who i need to contact about it please.

I can't help I'm afraid but I suspect the answer will depend on whether or not you are in a Comunidad ?

There is a limit to the height of boundary/party walls, a maximum of 1.2 metres for the solid blocks (excluding pillars).  You are allowed to put trellis/terra cotta bricks above this to a height of 2.2 metre (I think).  If you are unhappy with the work complain to the ayuntamiento and they will make him rectify the situation.

Who owns the wall ?

If it's their wall, nothing can be done (being realistic).

If it's shared ownership, simply knock it down and tell them to go F... themselves.

The people that live in FUE are mostly scum. So treat fire with fire, no compromise.

We dont know who owns the wall apart from we paid to have it buit in place of the wicker style number two that was originally there.
Only just paid to have it all painted .

That is a very broad statement calculator. I am sure a lot of people would take exception to that.
Having said that, I would in no way accept someone adding to a wall I had paid to have built.

mike p, I assume the wall that you paid to have built to replace the fence was a dividing fence between your properties ?? If so, did you discuss & agree this with your neighbours before the event ?

Yes we did and she agreed as it made her place nicer, allas she sold it and the new owners have been total scum having work done for the last 9 months or so causing so much dust and filth not to mention the noise .

Never seen the owners only builders.

wonder if old calculator counts himself as one of the scum. Or just an exception to the rule. ;)

What his comment does show is there's some very odd folk live on the island for sure. :o

Maybe it's a case of them not knowing who to contact !
Bit difficult to sort out from the uk though.
Could you not have the friend that sent you the pictures get a number for them & try to speak to them first. If that fails then the council is the next step. However they have acted, you still have to live next to them so I would exhaust any other avenue first before causing a potentially escalating boundary war. IMO

Thank you for that, i will ask him and test the water. We do not want a war we simply want our wall and paintwork reinstated as the local guy charged all the money to do a professional job and now its a mess.
I dont even know how to get hold of the people we pay to monitor and sort out manzana 11 .
Bit stuffed i feel.

Sorry, I know nothing about the area you are in. We just bought late last year so still finding our own feet however the people I have met so far have been v helpful, takes all kinds I suppose, just unfortunate if you got one of the bad ones. Hope you get it resolved to you satisfaction.

Mike sorry to hear about your problem. I live on manzana 10, I know there has been a lot of work going on on manzana 11 recently because many of the houses are owned by Norty Sur and are being refurbished for holiday lets, not sure if this is the case with your neighbour. If you have no contact details for your neighbour as you state then you need to contact the president of M11. I don't have details but it would be easy for me to find out if you want as we have friends on M11. They should get permission off the community before they raise the wall and if as neighbours you don't agree then the wall should not be raised any higher than the original fence. It is better to try and solve things amicably with the neighbour if possible maybe he could make good the wall on your side as things take so much time to resolve here it can drive you mad. If you need my assistance in getting you the details or need any other assistance, message me from this forum as it's not a good idea to share the details on a public forum. It would also be a good idea to speak to the M11 administrator so he can give you official advice I'm fairly certain I have his details unless it has recently changed again I can easily find out. I was the man 10 president for a few years. We're not all scum who live here.

On Tamaragua you should have a Manzana President, a Committee & an Administrator. It's the Law.
They should be able to help & advise you first. Do you know how to contact them?
Might be an idea in the short term. Costs nothing as long as you are paying your Community Charge every month.

by the way Mike P i don't think calling your neighbour total scum is the best way to handle your problem, if i was your neighbor you would get no joy from me if i knew you thought that of me

I do wonder some times when I read posts the answers are sometimes very basic but we tend to complicate things ourselves. Got to agree calling your neighbour scum on here when you haven't even met them is very odd and would get anyone's back up.
The comment about contacting the admin etc is basic knowledge as well but there seems to be a lot of people who don't even have these contacts and a lot of folk who do not even know how a community works.

I did use a wrong choice of word .
I came on here to try to find information regarding contacting the right people.
I did not come here to upset anyone or anger anyone.
I do feel somewhat peeved as i am sure you would if you had been in the same situation.

Last year they removed their utilty room to get a machine through to break the ground for a pool.
In doing so we ended up with rubble and mess on our patio and the freestanding pool was covered in dust and gritty substance making it impossible to see the bottom.
I kept quiet and cleaned it and cleared the patio washed the astro turf.
Then when we came back in December it was still going on and again filthy.
This time the wall was damaged and higher .
As a result of all the breaking we have a 4 foot crack in the bedroom wall that was not there before.
The workers started cutting and grinding at 8 am and did not stop untill 1800 sometimes 1900 .
during this time we had clouds of various coloured dust flying everywhere and making it impossible to sit outside.Again i said nothing because the neigbours wanted a pool and i know it has adverse affect on others .
I as i am sure you can understand angry and saddened to find out there is more damage to a property i keep 2 jobs going to pay for it as it still belongs to the bank untill i finish the mortgage.
I try to live and let live and leave people alone but enough is enough.
We are no able to read or speak spanish yet but we are learning .
I have unfortunatly never had any details of who to contact because we come and go without any problems.
As an end to it i thank every one who gave constructive information and wish you all well.

do you know the builder's name or the company with tel no, send me a pm and i will ask a few questions of the right people and see if it helps

So sorry to hear of all the problems you have had Mike.  It is very stressful when you live in the uk and have a property here and it takes the pleasure off visiting when you don't know what to expect next. 🙃

You need to speak to the builder.   The new owner may be totally unaware that the builder is annoying his\her new neighbours.  The builder needs to be told about the damage and given a chance to put it right.

It sounds to me that this problem may well be property owned by Nortysur, if it is then it was having a full refurb with view to holiday renting, i think they are having 4 refurbed, you don't say if the work now been completed, if it has then its a hard one to resolve, if the work is ongoing then pop round and have a word with them if no joy then contact Admin.

I admire your patience Mike, I would be in police cells by now. If you contact Thomas Hartman's office, I am certain he would put you on the right track regarding your situation. I would take photographs of any damage, the wall, the dirt, etc etc keep a diary, dates are important. Certainly make it known to the property owners the problems they have caused you to date, put everything in writing copying Thomas Hartman and the local council, plus builders, make sure you include photographs in your correspondence. The crack in your bedroom wall could be the start of long term problems, its important your neighbours are made aware they are responsible, why should you pay for repairs. The one thing I learnt in Fuerteventura is never let anyone see you are a soft touch and trust nobody in business, I mean nobody Spanish or any other nationality.

Esty would be a great contact for you, he's a veteran on Tamaragua and a decent guy.
