The Canarian government will not be able to reclaim 12 million euros paid years ago to a construction company for a failed project to carve out a giant hollow in Mt Tindaya in Fuerteventura to house a unique museum.

The controversial project for the so-called Peace Monument which was designed by prestigious Basque sculptor Eduardo Chillida, who has since died, hit insurmountable legal problems and had to be scrapped. The Canarian government had already paid out the 12 million euros to the consortium for the execution of the project and launched a court action to recoup the money, alleging that the work had not been carried out and therefore the original contract was null and void. However, after a battle lasting several years Spain's Supreme Court has ruled that the consortium was not responsible for the delays and eventual scrapping of the project. Judges laid the blame squarely on the regional authorities of the day for not ensuring that the neccesary approvals had been sought to excavate the mountain, which is a conservation site on account of its historical significance as a sacred place for Fuerteventura's ancient inhabitants. The Court has also ordered the goverment to repay the bond of 2 million euros deposited by the consortium at the time of the awarding of the tender.

If it works like the Uk negative economic variations normally filter down to regional and local government in the form of spending cuts. I didn't say they shouldn't be fined, just warning there could be a backlash. (if theres room for one)

Sounds about right for the Idiots that run this Island. How come they paid out all that money, even before a shovel full of dirt was dug.

Dead Catalan architect? Reminds me of the Holyrood Scottish Parliament debacle.... but even then we weren't so insane to hand over millions before a blow was struck, or to refuse permission for a site we already owned!

Yes, I know, Basque and Catalan are different, but still the same in an odd sort of way. Want to seperate, but in the meantime will screw central government over for every cent. Just like Scotland .....
