ALERT - NON RENTA TAXES - have a look at this important information

we discussed this tax this morning whilst with the walking group and no one has heard of it or paid it , do you you of anyone who has received these letters or anyone who has paid this tax ?

Have paid this since 2005. This year it has to be done online. Search on this forum for details I have posted about how to get online form and English instructions on how to fill it in. People have been paying 150- 200 euro`s to people to pay this tax. Its easy to do online with the instructions. The tax is not a lot for each property it was 76 euros for my house. Remember if 2 people are on title deeds you both have to fill in a tax form but you half the tax for each person. You need to know the catastral value of the property which you can get from the council (music square in Corralejo).

This is my take on it.

It appears that this tax applies only to those who OWN a property here and who are NON residents.  It is a notional tax for those Spanish home owners who do NOT rent out their homes.  It is ( as said above) based on the Catastral Value of the property which appears on your IBI bill.  It is paid in arrears, so a payment now will apply to 2011, and it has to be paid by the end of the year (31 December).  If your property is in two names, then each person has to use a separate Tax form, and the  calculated figure for the property is split 50/50.

I had my tax forms prepared by

www.spanishtaxforms.co.uk

for a total sum of £24.50............as they  base their work on a property and not per individual.They send you the prepared forms ready to pay.

I did this in the UK prior to my current visit, and then paid the tax at my bank here.  I know nothing about it being paid on line, so can't help there.  Our tax payable came to approximately Euros 102 each.

I have seen this discussed on other forums and many people think it is an unfair and even discriminatory tax on NON residents.  I also understand that it was taken to the EU some while ago to try to abolish it, but so far the tax remains.

I am surprised that there are still owners who are not aware of this tax. The form 210 is easy to complete however if, as is suggested, this has to now be paid online how do you make the payment?

You complete the form online then you have to have it validated by the tax office by clicking on a button, this then returns a number of pages (usually it will find some errors which you have to correct and validate the form again). Once the form has been validated and is on your computer print it out. You can fill the form out with instructions to take the money from a Spanish bank account (by filling in your bank details or if you fill in the deposit button on the form you print out the forms and take it to a bank). Solbank will accept the forms for payment. If you do print out the forms to take to a bank you need to take your NIE stickers for the bank to see (would imagine your NIE document would do as well.

My experience paying this Tax, my bank would not except the forms without the official envelope, and Sol Bank refused to accept my payment because I did not have an
account with them, fair enough. I eventually did manage to pay 2008 and 2009 tax years, 3 bed villa 83 euros per year (purchased forms and envelopes from the tax office in Rosario). I still feel very miffed having paid my wealth tax (700euros) only to find it had been suspended due to it being potentially illegal, I have been called a mug by a lot of homeowners living here for paying it in the first place.

They will always get you in the end, when you sell your property they hold back a percentage of the payment until they complete a search for whatever taxes you might owe plus any outstanding fines etc. I have a friend who is having a hell of a job getting his withheld money back, 3000 euros after seven months, he did not owe a penny, a guy who pays everything through his Solicitor.

You can no longer use the paper forms from the Hacienda to pay the tax. As you have to complete the form online there is no paperwork going to the tax office. So when you print the forms off the bank will accept them unlike before if you did not have the envelope they often refused to accept payment.

I do not have an account with Solbank neither do several people I help to complete the forms, but we have had no problem paying them at Solbank.

You can also pay with the forms through your own bank ( I did) there are three forms - the bank keeps one and returns two to you. No envelope needed. Seems not many people pay this as the cashier at my bank needed help from a supervisor to put it through the system, but got there in the end.

To be honest I was going to ignore this tax as I feel it to be discriminatory , but with the info I got a few days ago, I did not want to risk a frozen bank account etc.

Despite being a retired UK tax specialist I wasn't aware of this tax until earlier this year.

I/we had to catch up in 2012. the odd situations described of special envelopes, banks sending on forms and electronic submission of forms arises because the system changed from paper up to 2011 to electronic in 2012, so people catching up have 2 systems to handle. And yes, the banks aren't particularly up to speed on the procedure.

Once up to date, 2013 will be easier and I'll probably do it all myself online.

Can you not pay any tax for unpaid online? As the system is all computerised now and the facility online asks for the year which you want to pay would be an interesting experiment for someone who has not paid the tax for previous years to try to pay back taxes online. As a retired tax specialist you would be the ideal candidate to try it out.

I have also used Spanish tax forms.co.uk to prepare my forms for me although the advice from my Spanish Solicitor at the time was "Do not pay anything that the Spanish do not have to pay".

One thing to add to Emmis post above is that officially the "non rental tax", as I call it, is supposed to be paid for the portion of the year that the property is NOT let out. Regular taxes are also due on the amount of income received for letting out a property.

But no one lets their apartment out...........it's illegal!   ;D  ;)

It probably means long rentals not holiday rental. Surely it would be more sensible to legalize holiday rentals and pay tax on that income. Also if holiday lets were made legal it would encourage more people to buy property as an investment and all the empty properties would sell.Even more income and tax for the government.
