If you`ve paid for a holiday upfront ,way in advance, for a holiday for July of this year and since you`ve booked and paid, the said complex has decided to close for a refurb (closed April-June) and when it re-opens supposedly on the 1st of July will be a 4* instead of a 2*...can they now ask for more money?  ::)
I have receipts stating holiday is paid in full...anyone know the legalities of a situation like this?
Thanks in advance  ;D

If you even for one minute think that they will reopen on the 1st July you will be sadly mistaken. I would worry more about holidaying on a building site if I were you. Manana Manana.

If you paid by credit card try them for advice.

There is some doubt whether it will be finished on time  ::)

It was a debit card Dave...

They can't just rebuild and say it will be a 4 star. It has to be rated and awarded by the authorities. Sounds a bit iffy to me.

I have a holiday booked for the Dominican Republic later in the year with Thomson and in the small print it states that should the price of this holiday increase then that increase can be passed on to the customer.!!

Would this still be the case if you had paid in full? Guess I`m gonna find out soon as the holiday approaches...I`m reading on Facebook that alot of people who have only paid a small deposit are being told they need to find alternative accommodation  >:(

No they can't unless its a different company and even then they would have to honour the booking in my opinion.

If it's in Correlejo I'm there now and can have a look at the state of the building, if that helps Dee

Hi Paul...its the Dunas Caleta...and someone posted pics on Facebook this last week and everyone is saying that no way will it be finished in 2 months,I`m not an expert,so it is worrying when your booking agent is saying is all fine and we`ll be there for beginning of July  ::)

Sorry Dee we pass that place every day..At the moment all the apartments have been completely gutted..They are building some sort of structure on what was a tennis/volleyball court, but that is in the early stage of construction. To be fair they have a large number of workers on the site but I would doubt the complex would be ready on time.

That said, it's possible they may have some rooms ready by the time you go although the full facilities won't be...the pools will only be cleaned and refilled once all the building work has been done.

I'll try and have a word with some of the locals who are in the know and see if I can get some more info and I'll post on here. Awful position to be in Dee so sorry for you...

Footnote..just spoken to a contact who thinks it will be opened on time but thinks that the reception is still open so that's the next port of call..the upgrade is being forced on complexes by the Government to do up the infrastructure to a higher standard. Also they are supposed to offer you alternative accommodation if yours isn't available

Went to the reception and it's part of the building site, although a public holiday here they were still working on it and assembling the new air con units...spoke to Maitland at whereabouts shop,Austin 7 on here..Apparently your place has been bought by the  Labranda group, who also own the Aloe Club and Lobos Bahia, and it's going to be an all inclusive place.

The contractors are professionals and are on penalty clauses if they don't finish on time, hence your agents belief...Also the owners are a big group and do have spare capacity locally if yours isn't finished, so I think you can breathe again...should turn out OK..

The reason for upping the price is as the improvements and your contract with the previous owner who has since sold out....sorting that might be more of a problem.... Legal solutions there are hard to come by..

Anyway we are out at that time so if all else fails we'll help you pitch your tent on the beach!!!!!!
