Title: Be aware.
Post by: Joseph on April 02, 2016, 10:41:29 AM
There are many property owners in Fuerteventura who have not registered for property tax and the authorities are closing in.Back money and heavy fines can be imposed.
If you spend more than 183 days on holiday in Fuerteventura you can be liable to pay Spanish Taxes on any income ,at home or in Fueteventura.
If you let your property as a short term holiday let without regestering the fines can be over 30000 Euros.
Just be aware as authorities are now closing in..

Money in the back pocket, while business owners have no choice. One of my pet gripes.

"Just be aware as authorities are now closing in"  How about you give out some factual information?  Do you live on the island?

Looking at most internet property advertisements there is no property address and no owner names put forward. The only way they could locate the property is by photographs and they would need to have local knowledge and a shed load of luck to manage that. If the owners are non income tax payers in Spain they would have no address to send forms to anyway. All seems a bit hit and miss to me.
There must be ways they can find out but i fail to see it from the info they can get.

The authorities can get your info from the website owners or ISP's.

They will start by sending an e mail via the letting site or the owners website.

How much time and manpower they put into it remains to be seen but they need money.

They could well find the effort exceeds the return. I doubt there's many foreign homeowners renting their property that spend as much as 183 days on the island. Thus most will be declaring their income from rentals in the UK. Not sure where it would lead from there but it could be a good percentage they take time investigating are a total waste of time and money. Might be better off chasing any big multi national operators in Spain. Could pay far better dividends.

You still have to declare any income from rentals on the form 210 even if you pay tax in the UK.

You can be fined for non declaration and if you come to sell the property any non declarations will flag up on the system.

I see what you say. Just seems another layer of officialdom that will be of no financial gain

It appears the gain is not just the 6 years of back money for not paying property tax ,about 600 Euros ,it is the 30000 Euros or so fine when you sell the property.

When you say property taxes i'm taking it you mean council taxes paid to the ayuntamiento?

Joseph, for what its worth, the Spanish own thousands of holiday homes which they rent out and do not declare the tax, its not just the Brits. My experience with the Spanish Legal system and government (Local and National) has led me to the conclusion it would be a miracle if they set up an effective monitoring system for "Property Rental" tax evasion, their refusal to acknowledge the "English Language" or culture doesn't help their cause. There is also the area of "Property Management" and "Maintenance", I know far more people on the island "Spanish and Brits", who pay no tax in this business sector than I do who pay tax, its just the way it is, nobody loses sleep over it.

I`ve been looking at villas etc for a visit at the back end of the year with some friends and found that almost all property owners, no longer identify themselves, nor do they give out any specific details as to where the villas are. Now the prices are quoted, almost always in Sterling and payment the same way. To my recollection, it wasn`t always like that.

I agree it would be a very large nut for the Spanish to crack..They might have isolated results here and there, but that would be about it.

There is also the Non Resident property owners tax. Any non resident who owns property is required to fill out a Modelo 210 tax form every year, even if they don't rent out.

A guide to this tax.........http://www.advoco.es/most-requested-services/37-spanish-tax-form-210.html

Many years ago governments around the world created a web robot that collects info on web sellers, renters etc. Almost all the "work" is automated.

The fact they haven't done anything in the past doesn't prove they won't do some thing in the future.

Before moving out here, I lived for many years in Cheltenham in Gloucestershire, and around 2008/09
there were all sorts of rumours about the council hiring helicopters and planes to check for illegal extensions and swimming pools etc, which were generally laughed at, until 2010/2011 they started re rating selected properties, no one laughed much then, thankfully we were not involved, but i know a lot of people who got badly burned by it :(

I think the question that has to be asked there is if it's so easy to do why in the past have they never done it.

A friend of mine in Villaverde has received a big fine plus a bill for years and years of rates for his pool (which was there when he bought the property). And two of my neighbours received notifications just recently. The Spanish are getting their act together.

However, I thought there was a moratorium on private holiday rentals in the Canaries while they sort out legislation. And trapping owners on the web has been declared illegal I believe.

Your last sentence appears to answer my question.

That was in relation to the rental law itself.
