Hi, I've just received notification, via my solicitor, from the Agencia Tributaria (?) that I need to pay non resident's tax on 2 properties that I jointly own with my 2 daughters, aged 15 and 10. I was wondering if under 18's are liable for the non-residents tax if they part-own property? The demand only mentions my name and NIE.
All my direct debits etc were set up by my solicitor following my late husband's death and I (wrongly) assumed I was paying all the taxes that were due. I assume I will have to pay for the last 4 years, as I haven't paid before? Grateful for any advice, Thanks

There is a forum thread here which may help with some of your questions.

Basically you have a choice of whether to fill in an on-line form yourself (free to you)or ask the company named in that thread to do it for you at a reasonable cost.  I don't know about whether or not your children will have to have a form completed for each of them, but it is a question you could ask of  http://spanishtaxforms.co.uk/page/1on0t/Spanish_property.html.  It may be that each of you will have to complete an individual form if three names appear on your Deeds, but that the calculated tax will be shared between the three of you.

Yes I am sure you will have to pay for the previous 4 years, but it is not a huge amount of money as it is calculated on the Valor Catastral of your property which is usually a figure much lower than any  perceived value of   your property. You can find the Catastral value on your IBI bill.

As far as I know, this tax cannot be paid by Direct Debit to the Hacienda , only through a bank once the forms are completed.
